By accessing or using RouteAlert ("Service"), operated by RouteAlert LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
RouteAlert is a traffic monitoring and alert service that provides notifications about traffic incidents, accidents, road closures, and delays along routes that users have registered. The Service aggregates data from various public and commercial sources to deliver alerts via email and SMS text messages.
⚠️ IMPORTANT: RouteAlert is provided for informational purposes only. Traffic conditions change rapidly and our data may be delayed, incomplete, or inaccurate. Always verify current road conditions through official sources before traveling.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. SMS Messaging
By providing your phone number and consenting to receive SMS alerts, you agree that:
- Message frequency varies based on incidents on your monitored routes
- Message and data rates may apply based on your mobile carrier plan
- You can opt out at any time by replying STOP to any message
- You can request help by replying HELP to any message
- SMS alerts are not guaranteed to be delivered in real-time
5. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We specifically disclaim any warranties regarding:
- Accuracy: Traffic data may be inaccurate, outdated, or incomplete
- Timeliness: Alerts may be delayed due to data source delays, network issues, or system processing
- Completeness: Not all incidents may be reported or detected
- Availability: The Service may be unavailable due to maintenance, outages, or other issues
- Fitness for Purpose: The Service may not meet your specific needs
RouteAlert is not a substitute for exercising your own judgment about road conditions, checking official traffic sources, or making safe driving decisions.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTEALERT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Personal injury or property damage
- Missed appointments, flights, or other time-sensitive events
- Decisions made based on information provided by the Service
- Accidents, delays, or incidents that occur despite or because of alerts
- Failure to receive alerts or receiving inaccurate alerts
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
7. Indemnification
You agree to indemnify, defend, and hold harmless RouteAlert LLC and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any driving or travel decisions you make
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Resell, redistribute, or commercially exploit the Service without permission
- Use automated means to access the Service without our consent
9. Intellectual Property
The Service and its original content, features, and functionality are owned by RouteAlert LLC and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
10. Third-Party Data Sources
Our Service incorporates data from third-party sources including government agencies, traffic data providers, and emergency services. We do not control these sources and are not responsible for their accuracy or availability.
11. Termination
We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your profile settings.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pennsylvania.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
